Terms and Conditions
Academy of Fitness Business Pty Ltd T/A Academy of Fitness & High Performance (which will be referred to for the remainder of this document), owns and operates the nationally Registered Training Organisation (RTO) number 32278.
The principles of natural justice and procedural fairness are incorporated at all levels of our operation. Our organisational policies and procedures meet the requirements and stipulations of all Commonwealth, State and/or Territory Legislation relevant to our scope of operation.
Academy of Fitness & High Performance is committed to delivering fair, reasonable, and ethical dealings in all of its undertakings including:

- Payment policies
- Access and equity
This document outlines important information regarding your enrolment, the terms and conditions of your enrolment, your rights and responsibilities, and our obligations to you.
Once commenced there are no refunds for upfront payments or payment plans after a 10-day cool-off period. Payment plans may only be ceased upon completion of your required payment agreement. For Students with a medical or Allied Health certificate, payments may be placed on a suspension until medical clearance is granted for resumption of ‘normal duties’. For medical absence longer than three-months, your studies may be placed on hold for a maximum of six months.
Payment plan options
Students can elect to pay for their program participation via an interest-free payment plan. To be eligible for a payment plan you must confirm a set of fixed weekly or fortnightly amounts and agree to meet the terms and conditions outlined in your student handbook.
A written authority, signed enrolment form or application form submitted online is verification of consent to all terms and conditions associated with that payment plan, as provided to the student. If you default on a payment, it may require making a ‘catch up payment’ for the missing amounts as well as any third-party fees.
Credit card payments
If you have paid any part of your program fees via credit card;
- You are acknowledging that the card belongs to you or that you have express permission from the owner to use the card.
- If a third party (family member, friend or employer) will be paying for your service fees, please note that it is your responsibility to get permission from the card holder to add their name and credit card to your account.
If, for any reason, a Student has defaulted in their payment to Academy of Fitness & High Performance, then the remaining balance may be referred to either our solicitors or a debt collection agency for recovery proceedings. The Student shall be liable for all costs associated with the recovery of their debt including collection fees, commissions and legal costs.
Permission for use of image
Images may be taken on occasion. These can be used for coaching feedback and corrective feedback for the Student. You image may be used for marketing purposes and we will ensure you are informed when this occurs. Any images retained will be stored securely and never distributed to any third parties. You can request access to your images (if any) by contacting the administration team at Academy of Fitness & High Performance.
Academy of Fitness & High Performance collects personal information in its capacity to physical coaching and training. As part of our commitment to service, we are committed to protecting your privacy.
The personal information collected includes your name; date of birth; home address and telephone number; work telephone and fax numbers; email address and any medical conditions or disabilities.
The collection, maintenance and disclosure of this information is governed by the National Privacy Principles Act. We are also required to assure the integrity, accuracy and currency of personal information in accordance with the Australian Privacy Principles from the Privacy Act 1988.
Use and disclosure of information
Any personal information we collect is available to the staff of Academy of Fitness & High Performance and is used for the purposes of:
- providing appropriate training resources and programs
- seeking feedback from you on ways to improve our services
- administering and managing our training services including charging, billing and collecting debts.
Access and updating of information
Academy of Fitness & High Performance takes all reasonable precautions to ensure that the personal information we collect is accurate, completeandup to date.Theaccuracyoftheinformationis,however,predominantly dependent on the information which you provide.
Under the Privacy Act, you have the right to access your personal information and request that it be amended if it is inaccurate, incomplete or out of date. To amend personal information that Academy of Fitness & High Performance holds about you, please contact us on email@example.com
